Indiana Medical Review Panel Statistics: How difficult is it for a patient to win?
Since the inception of the Medical Malpractice Act in Indiana in 1975, there have been a total 27,272 complaints filed by patients within the state. According to a 2012 report by the Indiana Patient Compensation Fund, we learned that there have only been 2,117 financial payouts from the Indiana Patient Compensation Fund for those filed complaints.
Of the cases filed, only 13,973 of those received opinions from a medical review panel. According to the IPCF report, the medical review panels only found “malpractice” in 2,633 of the complaints. They found “no malpractice” opinions in 8,888 of the complaints, “Material Issue of Fact” in 686 of the complaints, and a “Variation of Opinion” in 1,766 of the complaints.
The conclusion from this study is that medical review panels only find malpractice offenses in 18.84% of all 13,973 opinions. Those numbers become even lower when we factor in the even larger numbers of original complaints filed.
