Settlement Reached in Wal-Mart Truck Accident Case
You may remember the tragic accident from last year that actor Tracy Morgan was involved in, and the injuries and death that were sustained as a result. A Wal-Mart owned truck was driven 20 miles over the speed limit and crashed into Morgan’s limo, leaving him with a severe brain injury, others with non-life threatening injuries, and one of their good friends, comedian James McNair (Jimmy Mack) dead.
The family of James McNair has been in settlement agreements with Wal-Mart and has finally reached a number that was “satisfactory to both parties.”
Although his family agrees that there is no financial number that will replace their father, son and brother, the money from the settlement will go a long way in helping the family maintain their lifestyle, and even continuing humanitarian efforts McNair was so passionate about.
Even though this case involved celebrities, semi accidents like these happen every day. In this case, it was proven that the semi was exceeding speed limits, but the driver was also nearing the end of his legal allotted driving window. Restrictions on truck drivers mandate that they don’t exceed too many driving hours each day without getting plenty of sleep, although drivers are finding more and more ways to circumvent the restrictions and squeeze in as many hours as they can each week. The National Sleep Foundation has found that tired driving is just as dangerous as drunk driving, especially when operating a large commercial vehicle like a semi truck.
