Medical Negligence and Malpractice Regarding Violation of Consent
Celebrity or not, Melissa Rivers is pursuing justice for her mother, comedienne Joan Rivers, and medical patients everywhere, alleging that what her mother was subjected to and what their family has suffered as a result, is something no one should ever have to deal with.
The suit against Manhattan’s Yorkville Endoscopy clinic allege that doctors who performed outpatient surgery on Mrs. Rivers were reckless, and their behaviors during the procedures were what ultimately led to her death.
Rivers was undergoing testing for some voice changes she was experiencing, as well as some reflux issues she had been dealing with, and had consented to a simple upper endoscopy (EGD), with the need for a possible biopsy or polypectomy if anything was found during the procedure. Once she was put under anesthetic, procedures were performed which she had not given written consent to, and the lawsuit claims she didn’t give verbal consent for either.
Before anything else was done, the doctors under investigation, Dr. Lawrence Cohen and Dr. Renuka Bankulla, performed a laryngoscopy, a procedure to which Rivers had not consented. The medical malpractice lawsuit states that after other procedures were performed, and Rivers’ oxygen saturation levels were dangerously low, an observing doctor who was not licensed to perform at that facility, Dr. Gwen Korovin, performed a second laryngoscopy.
Rivers’ should have been given an emergency tracheotomy as a result of her repeatedly low and unrecoverable oxygen saturation levels, but no such procedure was performed.
The charges in this case are extensive, but unfortunately, these behaviors are not uncommon, we just hear about them more often when the cases involve celebrity victims.
