Pelvic-Organ Lawsuits Against Boston Scientific Corporation
In the midst of facing thousands of lawsuits, Boston Scientific Corp. has just lost four federal cases, costing them $26.7 million in awards to four separate victims of their Pinnacle Pelvic-Organ Implant.
The product, one Boston Scientific claims was safe for use, has received complaints and lawsuits claiming it causes pain, organ damage, and results in uncomfortable sex. Boston Scientific claims that there are risks with all surgeries and medical products, and that just because some have suffered side effects doesn’t mean there is a defect with the product. However, the plaintiffs have shown that the mesh used in the product was never tested and approved for internal use by the original manufacturer.
As a result of these four federal awards, there will likely be a barrage of other cases won for women across the country who have suffered injury as a result of the use of this implant. These four cases were the first won on a federal level. The only previous win for a plaintiff against Boston Scientific was at a state level in Texas when a state court jury awarded $73 million in damages to a woman who claimed to have constant pain as the result of an incontinence implant. The trial judge cut the award to $34.6 million.
Boston Scientific is currently facing over 23,000 lawsuits for its pelvic implant device, and the majority of these cases have been consolidated before a U.S. District Court Judge in Charleston, West Virginia. The remainder of the cases is open at a state level in Delaware, New Jersey, Missouri, Texas, and California.
