$6.62 million settlement in a construction accident case. While working on a construction site for a commercial building, a worker suffered catastrophic injuries due to negligence by one of the subcontractors. A global settlement between parties sharing responsibility was reached for over $6.625M for the worker.
$4.57 million confidential settlement for underinsured motorist claim against a truck driver’s employer. The truck driver was operating a truck and was transporting materials near Tampa, Florida when he witnessed a motor vehicle accident and stopped to render help to the accident victims. During the course of the rescue efforts, another vehicle came along and struck the vehicle and seriously injured the truck driver. Suit was filed against the wrong doers employers underinsured motorist carrier. The underinsured motorist insurance company denied coverage. After years of litigation in federal court our client was acting like a “Good Samaritan” and therefore he was required to stop under Florida statute and render aid when he witnessed the initial collision. Therefore, coverage existed and underinsured motorists benefits applied.
$3.7 million settlement for young man that suffered paralysis to his lower body when a bucket of parts was negligently dropped on his head. The defendant argued that the client was a co-worker of the employee that dropped the bucket on him, thus limiting our client to worker’s compensation benefits. Wagner Reese argued that they were not co-employees because even though they work at the same plant, they were employed and paid by two separate companies. The case settled out of court after the Judge agreed that our client was employed by a different employer.
$3.0 million settlement in a construction site accident case involving a man injured when a pipe fell from the ceiling, causing paraplegia. Even though the accident was caused by the negligence of our client’s co-worker, we brought this successful claim against the general contractor who had a duty to ensure jobsite safety according to the construction contract with the premises owner. The settlement also included a waiver of a $1,000,000 worker’s compensation lien, thereby significantly increasing our client’s net recovery.

$2.5 million wrongful death settlement for a husband who was struck by a vehicle while riding his bicycle. This claim was against a young man who was driving a company-owned vehicle. Our client died at the scene and left a widow and two college-age children. The defense blamed the decedent for riding his bicycle too fast and having his head downward such that he could not see traffic approaching. Just before trial, the defense settled.

$2 million confidential settlement on behalf of a child who sustained multiple facial fractures when an unsecured TV fell on top of her face daycare. She sustained multiple facial fractures requiring surgery. Suit was filed against the daycare provider and a settlement was reached which included that the daycare make wholesale policy changes and perform regular inspections of all heavy equipment that have potential of falling on children.
$1.95 million settlement from motorist hit head-on at an intersection by a delivery truck driver. Our client sustained severe orthopedic injuries and fractures as a result of a delivery truck driver that we alleged was looking at his cell phone when he crossed through an intersection. After significant litigation, the defense finally admitted liability and settled the case.
$1.75 million settlement for a truck driver injured in a head-on highway collision. Our client had suffered a traumatic brain injury (TBI) which the defense disputed. We hired numerous medical experts to prove the nature and extent of our client’s brain injury, as well as interviewed our client’s past neighbors and co-workers who all testified that he was now a “different person.”
$1.55 million wrongful death settlement on behalf of three children of a woman who was a back-seat passenger in a vehicle that was hit head-on by a driver of a company van that had crossed the center line of traffic. The driver of the van had negligently been permitted to drive for the company, even though he suffered from a known heart condition. Suit was filed in federal court against the driver and his employer. The decedent was survived by three children, ages 18, 14 and 13.
$1.5 million settlement for the family of an elderly man who died while attempting to assist a stranded motorist in Southern Indiana. The disabled vehicle was struck by a dump truck loaded with gravel, which in turn struck our client, a Good Samaritan. The dump truck in question was found to have been negligently maintained, and an expert hired by our firm determined the driver of the dump truck was likely exceeding the posted 55 mph speed limit at the time of the accident.
Trucking Accident resulted in $1.5 million settlement for a pregnant woman’s personal injuries and fetal wrongful death. A truck driver was operating a semi under the influence of drugs, when he crossed the center line into oncoming traffic and struck an SUV operated by a pregnant driver. The crash seriously injured the driver and fatally injured the unborn child. The driver of the freight vehicle plead guilty to causing serious bodily injury while driving with a controlled substance in his system.
$1.45 million settlement for slip and fall resulting in severe arm injury to female that fell on defective steps at a hotel. This personal injury claim arose when a young mother was walking down a flight of outdoor steps at a hotel. The steps violated building code and were unstable. As a result, the young mother fell and severely injured her arm.
$1.25 million settlement for a young ironworker who suffered an open book pelvic fracture when a Bobcat operator backed over him. The defense claimed our client was fully responsible for the accident because he walked behind the Bobcat while it was in motion. We proved this contention wrong by hiring engineering and accident reconstruction experts to create an animation video demonstrating that our client was stationary before the Bobcat began backing up.
$1.055 million settlement for a 16 year-old student who was injured while crossing a roadway to board his school bus. When crossing the two lane road in a rural area near his home, an oncoming truck failed to stop his pick-up truck or yield to the stopped school bus which had its red, flashing stop-arm extended. The driver of the pick-up struck the teenager. Our client suffered a severely broken leg, which required multiple surgeries, as well as kidney injuries. During the course of treatment for his injuries, he missed several weeks of school for his treatment and rehabilitation. Medical expenses totaled over $300,000.00. A portion of this settlement was also recovered from the school system who designed the bus route to have this child crossing this roadway. It was also discovered that another student had been injured few years prior from crossing a busy roadway to board a bus. They have since changed all bus routes to ensure a higher level of safety for the school children.

The defense claimed that another motorist had “waved through” traffic and that is why he hit the pedestrian. The case settled two months before the jury trial was set to begin.
$715,000 settlement on behalf of a woman who was injured while she was a back-seat passenger in a vehicle that was t-boned by a speeding police cruiser. The vehicle in which our client was traveling in stopped and then proceeded through an intersection. The speeding police cruiser, which was not on an emergency call, was traveling in excess of 30 miles per hour over the posted speed limit without lights or sirens on. Our client suffered a fractured pelvis and other severe injuries. An investigation and expert review of the police car’s blackbox data revealed that the police officer was speeding and not wearing his seatbelt. Our client brought a tort claim against the police agency’s insurance company which resulted in a $715,000 settlement.
